ComPol tells COLA he won’t hand over the Penner files

Commissioner of Police Allen Whylie will not hand over any evidence in the private action brought by COLA against Elvin Penner. He said so by letter to COLa President Giovannie Brackett dated May twentieth, 2014. News Five has managed to get a copy of that letter in which the Commissioner Whylie states, “the Law by virture of Section twenty-four of the Freedom of Information Act, Chapter thirteen Laws of Belize, exempts information from being disclosed while an investigation is pending. In the circumstances, I regret that I am unable to accede to your request for disclosure at this time.” We note that while this is bad news for COLA, at least the Commissioner is admitting that he has the file. In an interview last week, Whylie quite amazingly claimed that he didn’t even know where the file was…and even worse, he claimed he was not aware that the Director of Public Prosecutions had requested it.



“Sir, we know that the D.P.P. has told the press that she has requested that the file be returned to her, the Elvin Penner investigative file be returned to her and at that point she would share it with COLA and their attorney who are doing a private prosecution.  Why has the file not been returned to her and how do you all feel about sharing the file with a civilian, actually a police investigative file with a civilian organization?”

“Well Jules, what you are sharing with me is news, I’ve heard nothing from the DPP in terms of she has requested the file to share.”



“It’s a matter of fact, she’s gone on the record and said that in fact she has made an undertaking to share it with COLA.  Are you willing to entertain that, that a police investigative file be shared with COLA for a private prosecution?”

“It’s not a decision from me, once the file is sent to the D.P.P. if she sees fit then that is her.  If she has the authority to do it that is fine.”



“Okay, so where is the file now?”


Allen Whylie

“Well, I’m not sure if the file is with us or with her.  I am not sure.  The last occasion I know the file had been submitted to her.  She hasn’t sent it back to me.”


COLA President Giovannie Brackett would not comment today, saying that he had to meet with his executive first.

    A word of wisdom to you Whylie, you just broke the law trying to cover up schemes and crime in order to save your behind, hustle all you can because I think you’ve figured by now that you’ll be joining the unemployment ranks as soon as government changes. I knew you as young boys and the family you came from off Tigris and Tanoomah streets. Admired that you had done something for yourself, but look at what you’ve become. Problem is, the little money that they gave you to cover this up won’t be able to sustain you if God gives you another twenty five years. What, you’re in your mid forties? I feel sorry for you. That’s the problem with the majority of us in Belize, we hustle but we have a con man’s hustle and that of an illiterate; we don’t think ahead.

    Whylie is the archetype of someone who has reached the level of his incompetence, the poster boy for the Peter Principle, if you will. He is marked by three traits: 1. Arbitrariness 2. Pigheadedness 3. Ignorance. Run last week’s video of him with the reporters again and you will observe the slack-jawed nature in which he responds to questions. He is focusing on trying to sound reasonable and intelligent rather than giving a coherent answer. That is why, at the time, he did not have a problem sharing the file with COLA. Now he has a problem with sharing the file. Try as you may but you won’t take the bush out of this boor. And….he is Perdomo’s fair-haired boy, so he won’t be removed.

    Clearly this arrogant individual is apparently not as intelligent as I thought. First he denied having any knowledge of the Penner file. He claimed he knew absolutely nothing about the whereabouts of anything and suddenly he decides that he will not share the files because of the ongoing investigation. I wonder if he knows if their is truly an investigation going on. These people who are employed to upkeep the law ensuring that the administration of justice remain intact through the law enforcement process are simply playing political games. Apparently this individual has no sense of dignity/integrity. Surely, arrogance and ignorance is like hand in gloves. He appears to think that he will be in this position forever. One day soon his good thing will come to an end. Every dawg has its day.
