G.O.B. versus Jamaican Gay Activist, Maurice Tomlinson; ruling to be delivered

The Caribbean Court of Justice convenes on Wednesday at its seat in Trinidad where it will hand down a decision in the case of Maurice Tomlinson versus the Government of Belize and Trinidad and Tobago.  Tomlinson, an openly gay activist, is challenging Belize’s immigration laws, following a trip to the Jewel in which he claims that the existing legislations impinge on his right to free movement.  The premise of the argument is the Revised Treaty of Chaguaramas which was ratified in 2001. Tomlinson is the former husband of former Acting Solicitor General Michele Daly.  While Tomlinson has visited Belize twice in the past, he was offered and refused invitation to appear as a speaker on gay rights issues in both countries. In Belize’s case, he was to visit at the request of the United Belize Advocacy Movement (UNIBAM) last January for a training session. The fact that he wasn’t prohibited from entering Belize forms the basis of government’s argument that Tomlinson should not be granted leave by the appellate court to seek legal action.  Section Five of Belize’s Immigration Act forbids, among other listed groups, “any prostitute or homosexual or any person who may be living on or receiving or may have been living on or receiving the proceeds of prostitution or homosexual behavior.” Tomlinson, since ending his relationship with Daly, has remarried Tom Decker, a Canadian pastor in New York. While the Tomlinson decision is due on Wednesday, the decision in the case of UNIBAM is yet to be delivered.
