Edmond Castro is taken to court for dereliction of duties

Minister of State Edmond Castro was in the Supreme Court this morning, defendant in a private claim brought against him. On February twenty-sixth, 2014, a resident of Belize Rural North, Trevor Vernon, filed an application for what is called declaratory relief, petitioning the Court to rule that Castro violated his oath of office. The application was born from the Belize Airports Authority issue in which Edmond Castro is accused of abusing his authority to receive checks from that body. It’s a landmark application, but it may not make it to full trial. Today attorney for Edmond Castro Senior Counsel Denys Barrow asked that it be struck out because he says it has no chance to succeed, no reasonable grounds and is an abuse of process.

“They brought it under a particular provision which deals with administrative law applications, constitutional relief, judicial review and claims for a declaration. But the particular rule is very clear as to when you can get a declaration. And it is that you can get a declaration against a state, against a tribunal, against a court or against another public body. Mister Castro is not the state, he is not a tribunal; he is not a public body, therefore this claim simply cannot be brought against him. For instance, if you were to sue a judge for what the judge said in court; the law is very clear that the judge is fully protected from any claim being brought against the judge for what the judge said in court. Therefore, similarly, in this regard, if you don’t have a legal basis for maintaining a claim; then the claim cannot go ahead.”

    You have to love lawyers and crooks. They never lose, make perfect sense when peddling b.s., and yes, leave us nauseated all the time. It leaves you wondering wether these thieving sobs will ever do time for anything. We already know the answer!

    The attorney for Castro is simply foolish. Castro is sworn to defend the Belize Constitution and Laws. Castro committed criminal acts by his abuse of his office and power. So ,mr. attorney for Castro, tell us that under what law he is not accountable to us and must stand the consequences if found to be a villain.

    Based on you simplistic and myopic interpretation of this law then Mr. Attorney this statute is null and void and should be set aside because no individual is the State! Problem he is not your average Joe off the Street. He was elected to serve the people therefore because of his office he is the State!

    Everyone of those members of the House are the State (individually or as a group)! Therefore he is the State and should be charged for all the embarrassing crap he did against the State!

    The attorney weh castro have just stupid wa man like castro I mi wa shame fi defend ina belize or any other court in the worl caz every body knw weh kinda man castro he da just wa thief and wa thief
    Will always be a thief worse if the have they back covered by all his team of camps……. some time pleople just wwnt the better for our country but with people like castro we wa end up the look bad all the time

    Well, he is the better of two evils when it comes to running against Arthur Saldivar. PUP has to replace Saldivar for Castro to lose. However, Castro has rubbed a few families the wrong way, especially in that Sandhill area and he will have a surprise come next election.

    Castro couldn’t afford his mother’s funeral expenses so how can he afford a big time lawyer? Or we are also footing that bill?
