Amendment to Criminal Code; is legal language favorable to gay rights cause?

While the issue of the passport scandal took center stage in the House last Friday, amendments to the Criminal Code as they pertain to sexual offenses against children and persons with mental disabilities were also introduced.  Special Envoy for Women and Children Kim Simplis Barrow has been an advocate for the revision of the dated legislation.  The proposed law includes several conditions to strengthen the existing Criminal Code with stiffer penalties for sexual crimes committed against children.  It also contains a provision for equal protection for male and female children from carnal knowledge, rape, incest, abduction, kidnapping and procurement by male and female offenders.  But tonight, there is controversy surrounding the legal language used in the bill which can be interpreted as favorable towards the gay rights cause.  Attorney Arthur Saldivar has sounded the alarm on what he sees as a conscious effort to once again surreptitiously introduce legislation favorable towards same-sex union.

“I just actually received a document from a friend of mine, sent to me by email, which represents the amendment to the criminal code. Amendment number two; which seeks to bring in this whole homosexual issue through the backdoor—no pun intended. What this seeks to do Isani is to give meat and substance to what the Prime Minister stated in his Independence Day speech. We know that it was a real unwarranted rebuke of the churches when he got up and basically stated that the church has the right the propagate its interpretation of morality and immorality, but he has the Prime Minister and the government, they have the purview and the authority to determine what are fundamental rights and freedoms. Well he never told the nation at that time that he actually had a legislation on the table. No doubt that legislation came from some foreign source; maybe it came from that five hundred thousand dollar gift that was given to that clinic that the first lady is looking to open—that’s speculation by the way. But what I am saying here is this…the amendment to section forty-six in this criminal code amendment number two, speaks directly to having any persons who penetrates the mouth of another person, the anus of another person, the vagina of another person without that person’s consent or being reckless as to whether that person consented would be guilty of an offence. I believe it’s rape and would be subjected to either eight years imprisonment which may be extended to a lifetime imprisonment. But the reality of it and the true effect of it is to bring now what is considered under section fifty-three to be an act against the order of nature—where there is a strict prohibition under the law presently—to one where a person has the right to chose.”
