Nembhard un Mexicano? Attorney wants Steve to pay up in full

According to Smiling’s Attorney Michael Peyrefitte, they are requesting that the money be paid in full because Nembhard has shirked the court order repeatedly and is now considered a flight risk.

“When the matter was finished on the twenty-sixth of May the court ordered that Mr. Nembhard pay three thousand dollars by the end of June and pay five hundred dollars a month after that until the payments completed the total amount owed.  The whole unique aspect of this case is that Mr. Nembhard gives as his permanent address and domicile Mexico City and that is the whole problem here because then why require the entire amount to be paid and for a surety to ensure that Mr. Nembhard will make the payment is because he doesnt live here.  He lives in Mexico City.  So upon the magistrate giving the order he was to pay the three thousand by the end of June and the balance thereafter in five hundred dollar installments.  A surety was required, a Belizean surety was required which was signed by Mr. Arnaldo Papi Pena but come the end of June the three thousand wasnt paid.  The fourth of July, between the fourth of July and the thirtieth of June we went through distress [and] there was nothing to distress so we had to apply for a judgment summons.  The judgment summons dictated that by the eleventh of July Mr. Nembhard was to pay the three thousand dollars and by the fifteenth of September to pay the balance.  Come the eleventh of July he still did not pay the three thousand dollars.  Yesterday some payments were made but then we have to come back to court tomorrow to make a final determination by the magistrate as to whether or not he would require Mr. Nembhard to pay all or pay in installments but we have to ask the magistrate but its the magistrates discretion.  We are going to ask him to have Mr. Nembhard pay all the money or have it be paid because Mr. Nembhard quite frankly doesn’t reside in Belize and if he leaves as given time to pay he may never come back.”

The matter continues before Magistrate Robert Ordonez on Thursday. Meanwhile, News Five has made several attempts to contact Nembhard for his side of the story but we were unsuccessful.
