Despite Chief Justice ruling, Gov’t still wants Sam Bruce’s land

Prior to his departure, former Chief Justice Abdulai Conteh, made several landmark rulings and in many cases, the client that lost was the government. In one particular case, a Benque resident sued the government for the four point four acres of land that the government attempted to swipe from him. Samuel Bruce intended to build a multipurpose center for the community on the land, but the government halted his project. And at the end of the court battle, then Chief Justice Conteh declared that the attempted acquisition was an error of law and reasoning. It seemed that all had returned to normal for Bruce but he was shocked to find out recently that his project would be on hold again as the juggernaut government is once again working overtime to take away his small property. Earlier today, News Five spoke to the upset landowner via phone.

“A Community park. The idea because I’m heavily involved in the community policing effort, which I strongly support the government in this action because everyone needs to take responsibility and do whatever you can to help curve crime. So the effort is to create a community park, to give activities for our youths—swimming pools, tennis court, skateboard, concession stands for food vendors and juice vendors. So we will get community participation within the park and all of this is done without any government money. It’s my contribution into the fight against crime. Since the judgment, we got back to work; we have several people requesting spaces to participate in this project, to set up their own business. And then, a few days ago I got a notification from my attorney that the government has decided to appeal this landmark ruling which is somewhat questionable because the judgment was on May eleventh. And I believe it was the twenty-seventh of September when they filed the appeal. It’s confusing because it’s twenty-one days, I was told, you have time to appeal the case, and it’s many months past that date so I am somewhat confused on how this can be allowed.”

In the Supreme Court case, Bruce was represented by senior attorney Said Musa. Bruce won thirty thousand dollars in damages, which he said he used to start a micro- financing program to help Benquenos start their own businesses.

    Mr Courtenay and Smith will tell you that a governement can take away anyones land so long as they are able to prove that it is doing so for a public purpose and if the governemt pay reasonable compensation to the owner of the property they have acquired. That is why Barrow was able to take over BTL. GOB COULD TAKE AWAY EVRY SINGLE PERSONS PROPERTY OF THEY ARE ABLE TO PROVE THAT IT IS FOR A PUBLIC PURPOSE AND THEY ARE ABLE TO PAY REASONABLE COMPENSATION IN A REASONALBE TIME.     That smell real fishy! GOB waited until the CJ is out before they refiled for that land. Mark my words, they’ll get that land. That’s a shame, cause it’s being used for something that’ll benefit the community. I don’t know what we’re gonna when we reach up s**t creek n we haven’t got that paddle, cause that’s where we seem to b headed under this leadership.

    If this story is true (only one side reported so far ………) – it is time to bring semi-anarchy to Belize. Post armed guards on your land with orders to shoot any trespassers…..And continue to build no matter what.

    If the Government will not heed the rule of law, why should you or me?

    Ultimate sovereignty of Belize belongs to the people/voters…..Government does not own this country – they are serving us, the people. If the Government is failing in protecting the Constitution, Rule of Law and us Belizeans, they need to be removed now and as fast as possible.

    We are heading towards Dictatorship and moving further away from Democracy more rapidly than previously……if this story is true.

    Having heard only one side of the story, I am somewhat confused. The thirty thousand dollars that he won, was it for damages or was it compensation for the property? School me…………somebody! Cause I got moe fu seh!!

    I just don’t understand how the Government can just take someone land away. I thought Belize was a democratic country and once you have a freehold title to your property no one can take it away at will. Please school me because this is worrisome to me since I have purchased land in Belize and I Have had enough STOLEN from me since investing in Belize and I know it is useless to go through the judicial system I have first hand experience with how useless they are so please tell me if I should use my Land Title for toilet paper.

    Good comments people; keep your eyes open with any governments mischief, if you follow the history of this case which begin in 09’ that was covered by channel 5, and Amandala newspaper and others, Mr. Bruce had started his park project 6 months before the GOB decided to acquire his property and give to a private institution that was proven to have an abundance of vacate land over 5 1/2 acres already and didn’t need Bruce’s land, the CJ took the supreme court to Benque to see the facts for himself, plus the error of law of using a public act to acquire land for a private institution wasn’t legal to start with, the whole case judgment is on the internet (Belize Supreme Court Judgments 09‘-10’) your question of $30,000.00 was costs awarded to Bruce his Attorney fees, however GOB has never paid, Since the GOB is spending public funds; Bruce in May pledged the money back to the people to start a micro-financing program to help the people in Benque to start their own businesses. The entire action of GOB in this case is of great concern for ALL land owners

    Hi Bruce don’t give up on your project.This G.O.B is nothing but for them self.They don’t want to see the poor survive.You are doing something to help the poor and all of a sudden they need land.Belize have so much land that they can go somewhere else and build. they can go to Spanish Look out and build there as well.with all the Land they give to the community over there .it is time to take some back from the people .TO take from you who is trying to help the poor.This G.O.B. is always taking away from peter to pay paul.have no idea how to make something from nothing.They took B.t.L. n now they want the poor people to pay for it.time to leave the poor people money alone and use their money.THIS G.O.B.     Most people are good in the world, unfortunately, most politicians never let go of some things and make it a personal vendetta to go after someone because they feel they still can or ‘while’ they still can. Hopefully the govt will change as it does over time and this will be a dead issue. As for Mr. Bruce, as long as people keep believing in his projects and works in Benque and surrounding areas there should be no concern.
