Missing case file and accused murderer freed without trial

It is becoming all too familiar; murder trial falls apart because the case file was not available.  The family of thirty-three year old Brian “Benji” Williams, who was gunned down in 2009, was expecting justice to be served when twenty-one year old Carl Dalton Reneau was charged for the murder. Instead, Reneau was freed today because his case file was not provided to the court by the police, which means that the preliminary inquiry could not start. So Senior Magistrate Sharon Frazer struck out the charges and an overjoyed Reneau ran out of the courtroom for a sweet taste of freedom after one year and four months on remand. On March ninth, 2009 Williams was painting a house at the corner of Nurse Findley Crescent and Faber’s Road when the first shot was fired. He grabbed a bottle to defend himself but was shot several more times before the gunman left the scene. While Williams’ sister, Leonetta, had claimed that her brother was shot innocently, police say the murder was planned and well executed.

    This is just too much, too much. How can a case file IN THE CUSTODY OF THE POLICE get lost? I don’t care if the police who lost it is corrupt or incompetent. Whoever lost it should serve the sentence for Reneau. That’s what the Romans did, if a policeman let a prisoner go, the policeman went to prison to finish the sentence. If a policeman cannot protect the public that pays him, then take his uniform and his badge off him, because he is worse than useless, he is a danger to the public.

    Robert is right, but there’s more.

    1. Why aren’t there MULTIPLE files to prevent disaster like this? In this day of “paperless offices,” there should be electronic/digital back-up of everything.

    2. Evidence and case files MUST be under lock and key, with only a handful of select people able to access them, AND with electronic surveillance so that if a person does something unauthorized, there will be evidence to hang him [figuratively]. That’s just basic law enforcement procedure, not something too expensive or too hard for Belize to figure out.

    3. Why would the victim’s sister say he was murdered “innocently”? Is there some relation between her and the murderer that should be explored? Odd and troubling.

    I am starting to believe that the police are working along with the GOB on letting criminals go free, it is cheaper to send them back on the streets knowing darn well that they (The criminals) will be in a body bag sooner or later…………………………………………………….works for me.

    How can a police department loose such crucial and important information. How is this police force structured? What is the chain of custody for these files? Seems there is no structure in place. The sad part is that this young man has just been given a license to kill again or be killed. I will keep watching to see what happens. Hope the police department will investigate this string of lost files, “some thing smells in demark,” and it is either incompetence or payoff.

    As I can see there are too many crimes in Belize this make think that I cannot travel to Belize. I was hoping to take a vacation to my own country. These so called law makers need to find a better way to fight crimes.

    This is no surprise to me that things like this keeps on happening in Belize. Case files are always myteriously going missing whenever the case is about to come up. Something smells fishy here and i bet someone is being paid off big time to “loose” those case files. The police and the DPP are slipping up on the job….they are getting slopply. It’s things like these that makes the law abiding citizens loose all faith and hope in our juctice system becuase it fails us everytime. The law ison our side nor is it in favor of the victims but there is always a loophole provided by the law that allows for criminals to get away scot free. Things have to change…..people will start taking the law into their own hands in order for justice to be served where it is due.

    The perfect crime. Kill someone, get arrested, go to court, walk out free. The catch, do it in Belize. The police will lose the case file anyway.

    Belize is slowly becoming one of the most CORRUPT countries on earth.

    Living good in the U.S.A, just shows how much you care about Belize. You sound just like “Jaz” who said that he is a US investor who wanted to invest millions in Belize but since he see how crime is going, he changed his mind. So stupid! When your day has come, it dont matter if you’re in the most peaceful place in the great USA.

    Instead you should make sensible suggestions on how to alleviate crime rate.

    The DPP and whoever holds these files should be made accountable for each missing file. Funny how the DPP just got appointed even though files go missing and cases especially for murder drop through.

    There is this beautiful thing called “Karma”. When you cause harm to someone, you may think you got away. Believe me whoever killed Mr Williams will definitely pay. It may not be immediate but 100% he/she will pay. Even if this chap didn’t commit the crime, I am disappointed to hear he ran out of courthouse, how insensitive? No courtesy, and respect for the family. Surely there are some standard behaviour expected from anyone present in the courts. I don’t expect him to dash out the door, what is that all about?

    when these files go missing, it should be that someone within that department would have to answer about their incompetence? In any other country the person in charge would be fired. In fact they would have to provide a detail account of what lead to this situation. What makes me anger is that no one sees it fit to answer to the public.

    Despite the fact that many of you believe that Belize is violent, I will argue that you are more peaceful than you realise. People express their indignation with a very peaceful protest on this site. In fact I find that you are more likely to fight amongst yourselves instead of focusing on the big picture. For too long both governments have failed to developed the infrastructure of Belize (For example the schools, health, police and fire and rescue departments). Keeping the masses uneducated/unaware, then they can do as they pleased without any challenge or having to answer for their actions. Only cozy up to the people for their re-elections. Perhaps as Obama showed America, its time for change in Belize. Surely the people of Belize deserve better.

    Losing high criminal files seem to b the new thing.I agree with the person who say that the Police dept should b responsible to the Public to secure the files, investigate the loss and reprimand the responsible person. If it is the same cops, then no fish market could’t beat the stench.FISHY,FISHY,FISHY!!!!!!!!!.I may live in the state but Belize is still my Paradise

    Disappearing files, blind, deaf, dumb witnesses, what’s new?That explains our 5% conviction rate for murder. Last month, another accused was shot outside the courthouse, two years ago another one was shot a few hours after he was acquitted. It all comes out in the wash . Jail? death? same difference.

    Charlotte, Belize is violent, our per capita murder rate is depressing especially for those of us who remember what it was like a generation ago. We have raised a generation of sick children & young adults who seem to believe that this violence is normal. One of our children almost murdered his classmate @UCLA & we were offended by what some racist student wrote instead of the violence inflicted on someone’s’ daughter. Maybe the violence in Belize left him traumatized, if so; accept i & address ways we can help the other kids.

    Most Belizeans are law abiding, the good citizens now live in cages in fear & look out at the world from behind burglar bars in even the best communities .

    If our children have to be housebound, we need libraries that are accessible to them. I am wiling to send work books & reading books as long as it goes to those who really need it & at no charge.. Let’s start with Yarborough folks, the churches? somebody?

    nice comments but the person to blame for all this is the pm who is not up to the task of running a country the only running he is doing is to the us to hide out because he is incompetent we need to get rid of this pm i lay all the blame on him has anyone of you heard this pm giving his condolances to any of the 200 families who have lost love ones noooooooooo he is too busy in the us with his nose up obamas you know what.

    I will not ask how come police officers can be so incompetent because we all know the answer to that question. I guess it only takes the right amount of money for a file go missing or shredded. BELIZEAN POLICE ARE CORRUPT…… THEY ARE NO BETTER THAN THE PEOPLE THEY SHOULD BE PUTTING AWAY. I AM SO ASHAMED OF OUR GOVERNMENT NOT DOING A DAMN THING TO STOP THE CORRUPTION. IT SEEMS THAT THEY ARE IN BED WITH THE POLICE OFFICERS AND THE CRIMINALS AS WELL. WHEN WILL BELIZE HAVE SOME REAL REPRESENTATION IN GOVERNMENT BY PEOPLE WHO CARE ABOUT THE COUNTRY AND NOT ABOUT HOW THEY CAN LINE THEIR POCKETS OFF THE BACKS OF BELIZEANS.
