Cpl. Fitzroy Yearwood says he was deceived

Story PictureThere is widespread public indignation that two accused murderers are out on the streets tonight following yesterday’s decision in the Belmopan Supreme Court that the prosecution was unable to continue with the murder case. The two accused, Joseph Kee and Taedron Bennett, were charged with the 2006 Mother’s Day murder of Phillip and Kevin Brannon that occurred on Albert Street West. The charges were dropped because the chief witness could not testify, that was what the D.P.P. said. News Five Jose Sanchez spoke to day to the chief witness who was pulling no punches.

The murder case that seemed to have all the evidence for a conviction by the prosecution, fell apart when according to the D.P.P. Cheryl-Lynn Branker-Tait, the key witness was ill and could not make it to court and had been hospitalized for diabetes until a week ago. But Corporal Fitzroy Yearwood had a different take.

“On Saturday I was right here on this very bed when the D.P.P. visited me. She came to me and she said do you have a problem if I get your doctor to sign a paper to get your something as my statement admitted as evidence or something. I said I have no problem with that because at the time I didn’t believe I could make it to court. She said ok, what’s the name of your doctor? I told her Doctor Hidalgo, Karl Heusner. So she said I’ll get in touch with him and I’ll get back to you. Now when I was listening to the news last night, actually I saw my picture on the news saying something to the effect that the case was thrown out because of me being unable to attend court. My thing is, Sanchez, if she came to me with a level plate and said to me this would happen in the effect I can’t get your statement admitted, I would have told the D.P.P. well, I know I’m not a hundred percent but my family is my support and I would have made it to court come to court hell or high water.”

“Do you feel your illness was used against you? Some people who don’t know you or your illness might have compared you to those officers who had amnesia. Do you think you have been given a bad rap in this sense?”

“I got a bad rap. My illness was used against me and it was used in a deceitful way because If I knew that’s what she wanted, I wouldn’t’ have opened my door. If you come to me and say one thing and hten when I look at the news on Monday night, it’s something else, how would you have felt? She used my illness against me.”

Karen Adolphus, who lost a son to violence, became a sympathetic ear to the mother of the Brothers. The parents declined to speak, but Adolphus was irate with the justice system.

“I was with the mother all the way, I feel for that mother. The reason why because I am a mother too that lost a son, 2003 May twenty-sixth I lost my son. This is what happened to me, I never had justice too. I never get justice. So ih hurt me fi si dat Miss Gilda, wah mother weh neva cry yet, from di day fi she son dead, she neva one day drop wah tear and now dis dah weh she wah get when she mi think well—she always tell me when I talk to ah—she seh Karen yoh know what, I lef everything inna di hands ah Jehova, I lef everything inna fi he hand and I wah get justice because fi we justice system good enough fi me. She mi think dat mi wah happen and why did the justice system have to deceive her? That’s what I want to know.”

But back on May fifteenth, 2006 in an interview from his hospital bed, Basil Brannon, who was injured but survived recalled the incident that occurred after a gold chain that fell from Phillip Brannon’s neck, was allegedly taken by a group, including the two accused. Charges against a third person, Ricardo Aguilar, were dropped.

“While we were there, I think it was Aguilar and some of them start to come cross. Taedron come cross to me and asked me what happened, I told him what happened. My brother asking, Philip you know what happened, no. So weh you di do? Move from yah. Taedron said something to him, he knocked Taedron. I pushed Philip and I said we don’t need to fight. Then what happened after that, I think is Aguilar that the one that tell Phillip I wa kill yoh. When he said then I get upset. We went straight up boulevard usual way we go home, down Yabra Bridge, Cemetery Road. My brother Kevin saw a vehicle di follow we. I tell ah no mein, he said yes di vehicle di follow we. So I said all right fu mek sure go in Cemetery Road; they know exactly where we live. They stopped at the lane, so I got out of the vehicle, because he had the key for my mom house. I said Kevin, give me the key. I got out the vehicle and I jumped the fence for the burying ground and the vehicle come around to follow the vehicle so I jumped and I run to my mom’s house. By the time I reach there and open the door and try get my licensed gun and his it was too late. All I hear was one brakes, noise after that.”

From the time incident occurred Basil Brannon realized that winning would not be easy.

“I think dehn mussy just think dat dah two or four black guys from di Southside and weh happen just happen. Nobody wah give wah damn, but they fail to realize that we are not only black people, but we are respectable people. Yes, we might be from the Southside, but not all bad people come from the Southside.”

“I’m a twelve year veteran, twelve years and I have never missed court, unless I am sick.”

“If the case would actually come back, you are going to be there?”

“The D.P.P. wouldn’t deceive me this time. I wouldn’t allow her to come and try and tell me anything. If I am even sick, if I am crawling, I’ll be there.”
