Eldon Arzu Emerges Victorious Over Chester Williams

In his decision, Justice James indicated that the Commissioner of Police acted in “bad faith” when he made several decisions that adversely affected Arzu’s ability to function as president of the Police Association.  During an interview with the press on Monday, ComPol Williams said that he will be appealing the decision.

“I think the evidence was so clear that there was bad faith, that there was bias in how Mr. Arzu was treated in these circumstances, all to an end, as how the judge put it, to prevent him from being the chairman of the association.  So the details were there where he got himself overly involved in matters of the association when those are for the central board to make a decision.  Officers who are higher than sergeant rank should not vote, should not be involved in association business. Additionally, he circulated a memo to all heads of department or formations that nothing Mr. Arzu does or tries to do as chairman of the association should be honored.  He moved and wrote to the bank, the banks where the association had an account, blocking any transaction by the association and putting a hold on the account.  So there are a number of actions by the commissioner which the court found satisfied the court sufficient enough to rule bad faith.  As a party to the claim, that’s his right if he wants to appeal.  And if he does, we plan to challenge it as strongly as we pursued this claim.  If he does so, however, and this is not my client’s view, it is my personal opinion, it would be a sad state because this is not really about a win or lose situation.  It is really him having certain powers as the commissioner and having those powers how he uses them to operate the police department.  That is what the case really looked at and the rights of an officer and how those rights were violated.  So in terms of the appeal, we are as confident as we were in the claim that the evidence speaks for itself.”
