Case Management for Suit Against G.O.B. in Butane War

Audrey Matura

A case management session was held this morning involving attorneys for the Government of Belize and the former LPG importers who have since filed a constitutional claim challenging the legality of a decision to cancel their license to import butane into the country.  Since the National Gas Company has become the sole importer of liquefied petroleum gas in Belize, previous companies, including Gas Tomza, have filed suit.  Attorney Audrey Matura represents the trio of former importers.

“We filed the constitutional claim, Claim Number 151 of 2020 against the government, it’s a constitutional claim.  We had tried to get an injunction with the hope that the damages and the losses that my clients are suffering right now could be mitigated or stopped.  We weren’t successful in that but that wasn’t the case itself.  You know these cases take different angles, the actual substantive case, today we had case management of that.  Case management is that now the court will tell us deadlines by when we should do disclosure, give affidavit evidence, have a pretrial memo and in between whatever applications we need to make.  So today we literally sat down and did a timetable for the case and after that then we’ll have hearing and I can say that the hearing will be at least by end of the year because we get to do our pre-trial review on November twenty-fourth.  So both sides agreed to dates and that’s where we are.  In terms of the actual substance of the case, nothing has happened yet.  You know the most that came out was during the injunction and the trial itself, that is still pending.”
