Darwin Prado and Egbert Baldwin Freed of Attempted Murder Charge

Two men, who were on trial this week for attempted murder, are free men tonight after the Judge upheld a submission by the defense that the accused men had no case to answer. Darwin Prado and Egbert Baldwin of Ladyville walked free today when Justice Colin Williams agreed with a submission made by Defense Attorney, Oscar Selgado that the Crown had not proven its case against his clients. Selgado argued that in accordance with section seventy-three of the Evidence Act, the Crown had not established—either through sworn testimony, forensic evidence nor via a written statement given by someone who is now deceased—that the two accused men are guilty. Prado and Baldwin were charged with three counts of attempted murder upon Terrence Flowers Junior, Casey Lozano and Lyndon Gillett for a shooting that occurred in a yard on Compassion Lane in Ladyville on the night of May thirteenth, 2016.  Selgado argued that the man who gave the written statement to police from his hospital bed, Casey Lozano, was not in the frame of mind to have soundly recollected the details of the incident. Lozano died in an unrelated incident following the shooting. Another witness, James Crawford admitted that he had been drinking before the gunmen approached and opened fire. A third gunman Lionel Rhamdas was found dead at the scene that night.  Police believe that he was inadvertently killed by his accomplices.
