Driver Who Knocked Down and Killed 10-Year-Old Yet to be Charged

On Monday, ten-year-old Steven Torres was laid to rest. He was knocked down and killed in his home village of Libertad in Corozal. He was killed by a butane truck which was being driven by San Joaquin resident, Yuri Lucas. Lucas has been served with a notice of intended prosecution and was released after police received instructions from the Officer of the D.P.P. Lucas has yet to be criminally charged. Today Commissioner Chester Williams explained why.

“When we have traffic accidents it is called accidents. It is not an intentional act and so it is incumbent about us as a responsible department to conduct the investigation to liaison with the D.P.P. office on these issues where there is no clear evidence of who is at fault. Then the D.P.P. office is going to guide us as how to proceed with the investigation. In circumstances once it is clearly establish who is at fault then we don’t consult the D.P.P.  We will proceed right away and charge. This is one such case where it is not clear who is at fault. In fairness to the driver, we have to go through what we normally do in terms of consulting the D.P.P.  I empathize with the family, I understand how they feel but I want them to also understand that there is a process that we must follow and to please work with us and let us see where the process will take us.”

“But at the end of the investigation are you able to say if that driver will be criminally charged?”

 

Chester Williams

“I cannot say that. That is a matter for the D.P.P. office to determine having looked at all the relevant evidence then they are going to determine whether or not there is sufficient to charge the individual for the accident.”
