CitCo’s Assets at Works Department are Crow-footed in Lieu of Payment

With an application for appeal setting the backdrop for CitCo’s next move, has a preemptive strike by Miller to crowfoot its assets, backed City Hall into a corner?  Here’s how the buildup that led to the drama at the Works Department on Monday afternoon all unfolded.

“Yesterday we were a bit puzzled by the back and forth, the marshals came to the office and we were in a discussion through their attorneys, not through me but attorney to attorney.  But we felt that the claimant was acting in a disingenuous manner because at first instance she requested fifty thousand during the course of the day and in the back and forth with our attorneys they said, “Listen, we are willing to take a letter of undertaking from us saying we wahn pay you the fifty thousand next week.”  [That’s] because we understand that if a judgment comes out we, as a responsible council, have to make some sort of commitment who won the case.  And so we were taken aback when our attorney was drafting that letter that they came back and said that they don’t want the letter of undertaking which would have made us pay the fifty thousand next week Tuesday.  They wanted the fifty thousand today, which was yesterday, and the thing is that they kept moving the goal post on us.  Thereafter, the fifty thousand, they took it up to a hundred and twenty-five thousand, immediately for the day; then a hundred and seventy-five [thousand], a portion this week and a portion next week.  It was just a situation where there was no end in sight.  We were acting in good faith.  We knew that a ruling has been issued to us and as a responsible council we wanted to act in good faith all the while.”
