P.S.U.’s Deadline to Vacate HQ Fast Approaching

The Public Service Union is pressing ahead with a legal challenge to regain its former Hilltop headquarters in Belmopan. The P.S.U. has been issued a notice to vacate by Estevan Perera, attorney for Simplex Designs- the legal owner of the property after it was sold by the Belmopan City Council.  The P.S.U. has been given until October thirty-first to move or be forced out.  The P.S.U., however, says that it will stand its ground as it says that is has come in possession of a critical piece of evidence that can determine the case positively for them. The union has acknowledged that Simplex Designs is the legal owner of the land but says that the process in which it was sold is illegal. While the P.S.U. has issued two press releases addressing the matter, the union has yet to communicate their position to Simplex Designs, according to Perera.

“We have sent the notice to vacate to the P.S.U. and we are waiting the thirty day period. They do have until the end of this month to vacate or to send us what their position is. We have notice the two press releases that they put out. We have not received anything formally from them or their attorneys and so we waiting to see what will be their formal position in respect to that matter but we haven’t heard on.”

“The president of the P.S.U. mentioned in an interview that Simplex Designs is the legal owner of the property however the process if flawed. It was illegal in terms of the sale. What do you make of that?”

 

Estevan Perera

“Well again we don’t know what they are referring to at this point. We are hoping that at some point they would send us something formally. We only heard the same thing that you heard. That’s not a legal position. We don’t know what exactly or what grounds they are standing on. Until they respond to our letter indicating what their position is I won’t be able to say exactly what they are thinking at this time.”

“They are claiming equitable interest I think the president mentioned.”

“We too noticed that there was a mentioned of that. Again, that is not very specific. Equitable interests in our laws mean an array of different of interests. It can range from an interest that would mean some kind of improvement that they possibly did to a number of other equitable rights that I can name for you. Again I don’t want to speculate as to what their position is or what specific equitable interest they are refereeing to until they send us something legal putting forward their position.”
