Is Political Interference Taking Place at Lands Registry Over Progresso Heights?

While an attempt will be made ahead of July thirty-first to get the cautions lifted, Courtenay says that there has been a complete abuse of process where it concerns the lands registry.

Eamon Courtenay, Attorney for Progresso Heights Ltd.

“It seems to me that we will make every effort now, between now and Wednesday to try and get the cautions lifted, if we can do so administratively and then proceed against Mr. Elrington personally for damages.”

“This is one of perhaps two or three, if not several, claims that have come before the court regarding Mr. Elrington and Progresso Heights.  Is there anything else of interest to this particular case that we may need to know about?”

“Well I think it is just sad.  What you have is a clear case, in my opinion, of interference by political operatives, and in this particular case Mr. Elrington with the administration of a registry.  Here is a company that was in the business of selling land.  It was in the middle of selling more than a dozen pieces of land, [but] because of the cautions they could not complete those sales so all those monies had to be returned to the persons.  The persons wanted land, they can’t get the land, the company has not been able to sell any other land now because of these cautions in place and it is eight years later and here we are.  It is a disgrace, in my respectful view, that the administration of the registry is subject to political control in matters such as this and it is really regrettable that it has taken so long for this matter to come to trial.  It’s not the court’s fault.  Every absolute application we have made, however simple, Mr. Elrington has first of all objected, then he’s traveling so much, he can’t come, so that the matters have just been repeatedly adjourned.  So that’s rank abuse of the whole process, but we believe that the matter will be dealt with aggressively on Wednesday next so that there can be some finality to this.”

The case against Wilfred Elrington has been adjourned to July thirty-first.
