Will P.U.P. Mount Another Legal Challenge?

Representing the People’s United Party today in place of lead attorney, Senior Counsel Eamon Courtenay was attorney Kareem Musa. According to Musa, his clients have been consulted with respect to G.O.B.’s application to have the injunction discharged since it was just announced this morning. He says that the second referendum bill clashes with the court proceedings especially as it relates to the Special Agreement.

“We haven’t gotten any information from the government until this morning when I showed up at the court my learned senior Ms. Shoman, indicated to m e that they wanted to apply to discharge the current injunction that it is in place. As you know the clients were required to be here today so I have not has an opportunity to consult with them to get their take and also to consult with senior counsel Eamon Courtenay because he is before the Senate. The judge quite rightly and properly set that as a separate date, not to be heard today but on the twenty-night of April.”

“What happens now after the new referendum bill is passed? Also in terms of the writs of referendum because I think the Prime Minister mentioned last week the writs are date specific but the substantive matter is based on those writs. How does the proceeding move forward in light of that and of the new bill?”

“As you know the new bill and we argued this profusely in the House of Representative, the new bill at clause three says that we are now going to a referendum in accordance with the Special Agreement, the very Special Agreement that is the subject of debate and argument before these courts in Belize. What we saying though is that this new bill goes and touches the very thing that is before the courts that is the Special Agreement. So therefore it has to come in contention. It has to come into play in these proceedings.”



“So you will be asking for another injunction if I understand correctly.”

“Well, let us deal first with the first aspect. There is still not a discharge for the current injunction. So we have to await that application and that is why we’ve been saying that there is no need to be rushing this thing because when you look at all the other bills that the Prime Minister has taken to the House, it is always at the conclusion of the court processes. I believe in the current case that is before the court, there is an opportunity for us to amend once again because again this is something new, fresh that is coming out of the Government, so we can’t include as part of the claim. If not and it is denied then certainly the Opposition might want to consider filing a new claim.”


The matter was adjourned to April twenty ninth.
