Emerson Eaghan Freed of Murder Charge

He was charged with murder in 2009, but tonight, twenty-seven-year-old Emerson Eaghan is a free man. He walked free on Monday following a decision by Supreme Court Justice, Colin Williams.  Crown Counsel Kileru Awich entered a nolle prosequi, signifying that the prosecution did not wish to continue with the murder trial against Eaghan who was accused of fatally shooting thirty-five-year-old Dennis Nembhard in June 2009.  According to court details, Awich entered the nolle pros because Nembhard’s mother, Elizabeth Sheran, who identified his body, had passed away. A statement by a relative to verify Sheran’s death would have allowed for her affidavit to be accepted during trial. When that was not available, Eaghan was freed.  He was originally convicted of Nembhard’s murder in 2012 and was given a life sentence. He appealed that sentence and a retrial was ordered. Eaghan was recently released on a forty thousand-dollar bail. He was represented by attorney Nazira Myles in court on Monday.
