Defense Attorney Says Detention is Not the Solution to Crime

The legal basis for establishing the state of public emergency in two areas is coming under question in many quarters. Defense Attorney Dickie Bradley, is also opposing the state of emergency in the south side. He has been a long standing advocate for rights guaranteed under the constitution.  He says the arrests are not the solution to crime.

“This is an issue that is huge; this is a very big matter and please don’t let it just be a couple days wonder—follow it up. It is a complicated matter to try to explain in a few minutes because the Constitution of Belize which is our supreme law provides for a period of emergency to be declared. There is provision in the Constitution; in fact, interestingly that provision follows those things that you were referring to as the bill of rights; those areas of our Constitution from section fifteen to about seventeen that list down one after the other in a chapter devoted entirely to the fundamental rights and freedoms of Belizeans. Your right to your life, to liberty, to your privacy; the right to your correspondence, the right to your freedom of expressions, the right to your religion of choice, the right to association, the right to work, the right that you can’t discriminate against me on the basis of my race, my creed, my colour, my political opinions. There’s a whole heap of things that are guaranteed. The Constitution gives you an idea of what is being talked about when you speak of an emergency: there is a flood in the River Valley, there’s a hurricane in Dangriga, there is a massive fire that has disrupted life, there is a riot, there is a war, there is insurrection; there is attempt to overthrow the government. Those are what you are looking at.”

“…clearly not, clearly not. You cannot tell me that pahn Banak Street that first of all every house is a major problem for us or every young man living in those houses have caused a state of emergency. It is a bogus attempt by politicians who are facing the biggest month of celebration in the country.  This situation is a pitiful, sorry state of affairs that at the end of whatever period they are holding these people for, we will be right back where we started. It is not a solution; it is not a short-term solution. It is simply an attempt fi make there be no more disruption in relation to the bacchanal, the carnival and the drinking and carousing and the celebration of the September celebrations.”
