Can Government Save Crow-footed Items at BSWAMA From Being Auctioned Off?

Michael Peyrefitte

A number of items, including equipment and vehicles, were crow-footed at the offices of the Belize Solid Waste Management Authority in Belmopan last Friday.  BSWaMA was ordered to come up with over half a million dollars in compensation to the company, following the outcome of a lawsuit which was brought against the statutory body by Vision Architects and Contractors.  Since it failed to appeal the decision of the Supreme Court within a twenty-one-day period and no stay of judgment was granted, the authority was written to by attorney Naima Barrow on behalf of her clients.  When those letters went unanswered, a move was made to crow-foot the items for auction.  Earlier today, Attorney General Michael Peyrefitte gave a brief update on the situation.

Michael Peyrefitte, Attorney General

“As far as I know, an application was being made that was filed yesterday to remove the crowfoot from the items and without getting too much into the details of a pending case, that’s all I can say on this matter.  The Solid Waste Management situation.”

“So you can’t say how it got to that point?”

Michael Peyrefitte

“No, I mean it’s a live case.  I won’t litigate a case that’s live in the public.”

“Have they removed anything yet, is that what you’re saying hasn’t happened yet?  You’re trying to stop it?”

Michael Peyrefitte

“As far as I know, they haven’t removed anything yet because I know there’s a period between when you crowfoot it and when you actually go to auction it off.  So during that period is usually when an aggrieved party, if they believe they’ve been aggrieved, they can apply to remove the crowfoot.”

Isani Cayetano

“So is the department still operational at this point?”

Michael Peyrefitte

“As far as I know, yes.”
