AG on Recently Passed Anti-Gang Legislation.

Since the recent passage of stringent anti-gang legislation, there have been concerns about the scope of the law and how it will be used to crack down on persons believed to be keenly involved in organized criminal activities.  So what happens in a case where reformed gangsters continue to bear the markings of their respective sets in tattoo form on their bodies?  Will they also be subject to the Draconian laws that are now in effect?  Here’s what the attorney general had to say on gang insignia.

“If you simply have that on your skin and you are a former gang member, it is not that tattoo alone that would make the police deem you to be a member of a gang.  It’s your behavior, it’s how you use that insignia.  If you happen to have an MS-13 on your chest because you are a former MS-13 gang member but you are now reformed, you’re a hard working, honest person and you’re in the system, the mere fact that you are in there will not make you deemed to be a gang member by the police.  If you are on the internet promoting it, if you are in the streets promoting it then that is different.  You are clearly declaring yourself to being a member of that gang.  It is not the mere fact that you have it on you means that you will be charged for it.  The legislation is very clear that these are the things that will provide that initial step for the police to look into you.  But once the police has done its investigation then they can decide, look, this is a former person, a gang member, this is a reformed gang member or this is just a person who likes that particular tattoo.”
