Review on Whether Marriage Makes One a Belizean

Nigel Hawke

Also questioned was the matter of nationality through marriage to a Belizean. As seen in the case of Peter Dahlstrom, section eleven of the Nationality Act requires persons registering to be Belizeans to be both married to a Belizean and a resident in the country for one year. Dahlstrom was allowed to qualify by virtue of repeated visits. But whether he qualifies now is subject to legal review as promised by Solicitor General Nigel Hawke.

“I would probably require, to be fair, some time to look at that, to give a full and comprehensive analysis of the thoughts of the chambers of the Solicitor General on that matter. But subject to your guidance and leave, I would think that is a section we would need to look at very closely, have the legislative drafters look at it also, and certainly we can undertake to provide a comprehensive opinion as to our interpretation of that section to this honorable Committee, provided that that suggestion is amenable to this Committee. I wouldn’t want, and it’s not in general practice – you’ll forgive me – as attorneys for us to give opinions off the cuff; so I would want to do a proper and comprehensive analysis on it.”
