P.M. Barrow Concedes Errors in Settlement Agreement But It’s Not All His Fault

The drafting of the settlement agreement between the Prime Minister and Lord Michael Ashcroft, as well as their respective attorneys, has been criticized as poorly put together.  The CCJ bench has clearly stated the terms outlined in the agreement ought to have been fine-tuned, thereby preventing legal back and forth over the quantum, as well as the currencies. The PM conceded with a mea culpa.

“I disagree with the judgment and I believe that if the court had examined the claimed liabilities in the way I thought it had a duty to do, the result might have been different.  But there could never have been any question about misleading, what the court said indeed was that the agreement was not particularly well drafted and it blamed both sides.  It said both sides have the fault and I would concede that, but the position that I adumbrated which was that any portion of the arbitration award which could be attributed to the accommodation agreement, should come back to the people of Belize, minus only the liabilities, the expenses incurred by these people in trying to get that award which was fair.  That was and is, remains the truth.  The question always was then, how much are those liabilities. There may be obvious boners in terms of this particular agreement and the particular wording.  If I missed some, as you call it, lacuna, then I will be perfectly prepared to engage in some mea culpa.  The large question though, was the need to reach settlement at that particular time, a settlement with honor, a settlement that would provide for some special treatment of the accommodation agreement portion of the award.  So I’m satisfied that that is what I tried, to do, that is what was provided for.”
