Why challenge Franz Parke in Supreme Court?

The Bar Association and the Belize National Teachers Union are on record saying that Franz Parke does not qualify as a Justice on the Court of Appeal. The opposition has gone further and filed a legal motion against the appointment of Parke, who is already sitting in this session of the Court of Appeal. That claim was brought before the Supreme Court last Wednesday by Senior Counsel Eamon Courtenay on behalf of John Briceño. We asked Attorney General Michael Peyrefitte to shed some light on how the process works, since Parke, now a sitting judge, would be challenged in the Supreme Court.

The claim brought by the Leader of the Opposition, can you enlighten us as to how that works insofar as this matter being brought before the Supreme Court but it involves a Court of Appeal justice?  How does that work?”

“Well maybe you should have asked the Leader of the Opposition how it works.  I am tempted to comment but as I promised when I became Attorney General, I will not comment on any matter that is live before the court and I will maintain that position.  The Leader of the Opposition has chosen to go to court and so let the court speak on it.  I won’t speak on the merits or demerits of the case, but let’s just say your question is interesting and maybe it should be put to the Leader of the Opposition.”


Parke reported to work at the Court of Appeal of Belize earlier this week and it is expected that he will preside on matters before the court in the months ahead.
