Former Magistrate Panton dismisses leaked documents

According to Panton, Police Constable Shedrick Caliz presumably made an about-face and decided not to proceed with charges when he failed to produce a medico-legal form after allegedly roughing up the brothers. As for the leak of several documents, said to be charge sheets that were filled out for Jafari and Wasani, the validity of those papers are being called to question. The former magistrate says that since the brothers were never charged, those sheets of paper aren’t effective.

“I left the station close to midday.  I was at home having lunch when I got a second call and I was asked to return to the station and when I returned, that officer indicated that he had a change of heart.  I don’t know if up to that point the did not realize that there would be counter-charges filed against him.  I suspect that when he heard medico-legal form his good senses got the better of him and he indicated that there would be no charges laid and we indicated that we would file no action against any of the police officers that were involved at that time and that, I believe, should have been the end of the matter.”

“In respect of the actual forms that are floating around elsewhere in the media, can you speak to us on some of the glaring discrepancies when one peruses what both documents should look like, primarily in an official capacity?”

“Well I sat on the bench as a magistrate for a year and a half so I’m well acquainted with all these documents that are floating about.  A charge sheet is a separate and distinct document from a court book.  What was brandished on TV this morning by Louis Wade as a charge sheet, was not a charge sheet.  It is a court book, or what appears to be a court book.  It does not have the requisite serial number from whatever precinct it would have emanated from.  So some idle police officer got hold of police stationery, filled out those court books and circulated them.  But a court book on its own is nothing.  What indicates whether or not these gentlemen have been charged are the information and complaint which, after they have been informed of their arrest and the reason for their arrest, is given to them.  As I told you, those were already prepared.  I saw them in the hands of the officer but no charges were ever read to my clients so my clients were never issued with any information and complaint.”
