Why Constitutional Challenge is Personal for Courtenay, Coye LLP

As we said, a constitutional challenge has been filed in the Supreme Court by principals of Eamon Courtenay’s law firm against the Central Bank (International Immunities) Act and Crown Proceedings (Amendment) Act.  The latter legislation is, as he explained to us, a personal matter, as he and fellow attorneys risk jail simply for advising their clients as the Government’s legal eagles do. And don’t hold your breath for a Courtenay resignation either: the P.U.P. says he continues to enjoy the full support of Leader of the Opposition John Briceño. Courtenay says that support and the wisdom of a famous former leader of the P.U.P. carry him forward.

“The attorneys in my office are affected by the legislation, because we have in the past advised clients and we are quite possibly going to have to advise clients in the future concerning this type of thing. And it cannot be right for the Government to be able to have its lawyer, and to have the advice of its lawyer, and yet we can’t practice our profession, by advising our clients; that if we do so, we are to go to prison. I don’t care what Mister Barrow says: this is unconstitutional; they have cut and paste legislation which the C.C.J. has already said is unconstitutional, and we are going to challenge it because it is illegal and unlawful. That is the position of my firm.”



“And finally from me, sir, your party has said that it fully supports you the Senate; says you’re doing a fine job and wants you to continue doing that – how gratifying is that to you?”

“All I will say about that is I am very grateful for the expression of support from my party, and also the many people who have sent Whatsapp messages and text messages, saying keep up the fight and don’t be distracted by the shenanigans of this corrupt U.D.P. Government. I will continue to press the fight. As Mister Price, the Father of our Nation, always told us: when your enemies praise you, you are doing the wrong thing; it is when they are criticising you, you know you are doing the right thing. And based on the level of criticism that the U.D.P. is coming with against me, I know that what I am doing is right, and I will continue to do it until this corrupt, illegal, unconstitutional Government is out of power.”


The Senator also told us he does not believe he is in a conflict of interest under Section one-twenty-one of the Constitution, as he disclosed his interest in his Senate speech on January thirtieth.
