Duo is Freed of 2011 Murder of Michael Finnegan Market Vendor

Ronlee Petillo & Matthew Smith

Late this evening, the trial of Ronlee Petillo and Matthew Smith charged with the murder of fruit vendor, Miguel Angel Rivera concluded before Judge Adolph Lucas. The murder occurred on March eleventh, 2011 at the Michael Finnegan Market. Petillo once again beat a murder rap and so did Smith. In the trial by judge alone, the Justice ruled that the prosecution did not prove that the duo murdered the fruit vendor.  That ruling came from a motion by the crown to continue the case against the men even though their main witness, Juan Guardado, turned hostile after he claimed amnesia on the stand. The judge found that the prosecution did not establish the link to the murder so he found both men not guilty of the murder.  Petillo and Smith wasted no time and rushed out of the court room. Defence Attorney Leeroy Banner explains.

Leeroy Banner, Attorney

“The crown case was built mostly on crown evidence and at the end of the day, his evidence did not come up to scratch to the proper standard and therefore, he became hostile. But his statement that he gave to police, even with that, there was not enough evidence to convict either of the accused. So pretty much after the witness did not live up to expectation, the case went downhill afterwards.”

Petillo also walked from the murder of Dennis Gladden. It was the first charge against Smith and both are free tonight.
