Gutierrez Says She is Afraid to Return to Guatemala

If the court rules that baby Nina was indeed removed from the country illegally, then the child will be ordered to be returned to Guatemala. Gutierrez would then need to return to that country to deal with the custody matter there. It’s a scenario that is not improbable, but one that Gutierrez dreads.

“I am definitely fearful because of what his family is capable of doing to me and my family in Guatemala. I fled from that country, from domestic abuse, and I sought the safety of my country where my daughter could be raised properly and safely and with love. And as well, on my part where I could be with family who supported me. So I am definitely fearful that the Court might make a decision to have her taken back because that would put her and me at risk. But at this point I just have to have faith that the judge will be able to review the proper documentation that we have and the decision will be made for her to be able to stay where she belongs, here in Belize with me.”

“I remain confident that we will be able to provide satisfactory evidence to the contrary and be able to then essentially have the Court make a decision dismissing his application altogether…his application for the forcible removal of the child from the mother’s custody and the transfer of the child into the custody of the Guatemalan authorities.”


So for now, baby Nina will not be with either of her parents for the holidays. All parties return to court on January eighth.
