Monchi and Gapi Back in Court

This morning, Chief Justice Kenneth Benjamin heard closing arguments in the libel and slander suits brought by Deputy Prime Minister Gaspar Vega against Ramon Cervantes Junior. The claim, in a nutshell, is that Cervantes arranged the broadcast of a recording, on Orange Walk based Fiesta FM, in which Vega is named as involved in the murder of Ramon Cervantes Senior. On July fifth, 2014, the tortured body of seventy-one year old Cervantes Senior was found in a shallow grave on a farm off the Honey Camp Road in the Orange Walk district. Today, all three attorneys – Rodwell Williams for Vega, Eamon Courtenay for Fiesta FM and Said Musa for Cervantes – presented their oral submissions.  News Five spoke to all parties as they exited the Courtroom at close to one this afternoon. According to Said Musa, the claimant never presented any evidence, recording or otherwise, to prove his case.

Said Musa, Attorney for Ramon Cervantes Jr.

“To this very day I am satisfied that the claimant has not proven with any kind of evidence, whether through himself or any other witness, that my client in any way published or caused to be published anything offensive against Mr. Vega.”

“Sir in terms of what is being said about that offensive material, it seems that there is a question that it was even tabled into evidence, that it was even brought before the Court.”

Said Musa

“Well exactly! There is no, as we call it in law, primary evidence of any such taped evidence. There is no tape in evidence. There is no IPhone recording in evidence. All that is in evidence is what we call secondary statements made by witnesses who heard a portion of what took place at Mameyal Farm. In other words the case was in our view very inadequate as presented in the claimant, and certainly did not establish proof of either libel or…that’s the other thing. My client is being sued for slander. Slander, you and I know, is when one person makes another statement against another person verbally. So why was he sued for slander whereas the radio station was sued for libel for the same matter?”

“Like the attorney said, the claimant has failed to prove his case against me. There is no primary evidence to substantiate what he is claiming against me. So in that aspect I think it’s going well.”
