BGYEA on Outcome of Mediation

Audrey Matura-Shepherd

As we told you, the contempt application was brought in relation to Court-ordered mediation which has now come to a close. The dispute was over the use of a buffer-zone in the Harmonyville community. BGYEA had been prohibited from planting corn in the buffer zone of the area which covers more than one thousand acres, and the contentious matter was ordered into mediation. It’s done now, and it is a victory of sorts for the grassroots organization, BGYEA.

Audrey Matura-Shepherd, Attorney for BGYEA

“For my clients it is simply that they are now able to use part of the reserve at Harmonyville to be able to plant. The most important thing, the trespass case, was dropped against Mr. Petillo. And also they are supposed to get some sort of assistance to get seeds to be able to plant, and also they were promised that the immigrants were squatting on the very land that they said these guys trespassed on, are to be removed. So it is officially now the order of the Court. We have to see that it is enforced. If it is not enforced then we have to come back to Court to see that it is enforced.”

“This thing has been going on a long time. In terms of Harmonyville, what does the decision coming out of the mediation mean for you guys on the ground?”

David Barnett, BGYEA

“Well we have yet to see the government do what they say they were going to do in terms of we have squatters out there still in the said buffer that they said they didn’t want us to plant corn. That’s really the big thing here you know, that we wanted to plant corn and generate money for our community. That has been taken away from us. In terms of planting out the buffer, we got permission to plant out sixty acres of land which is more towards the back. It’s plain to see that right now you have to be very careful what you say. Anything you say right now is so unpredictable in how they will take it. How these lawyers use their terminology, how they manipulate the system. We are regular grassroots people here to defend the poor, the oppressed, those who never had. That’s what BGYEA did. We formed Harmonyville…we managed to give out one thousand and forty plus acres of land. The government says they will clean the buffer now, they will take that as their initiative, and that’s all we really wanted.”
