Barranco Resident Appeals Conviction for Carnal Knowledge

Forty-seven year old Newell Lyn Nicholas was convicted back in 2012 in the Southern criminal session of the Supreme Court and sentenced to thirty-eight years imprisonment for three counts of Carnal Knowledge and one count of Aggravated Assault of an Indecent Nature upon an eleven year old girl. Today, he was before the Court of Appeal seeking to squash his conviction and sentence on the grounds that the judge had erred in law. The three judges of Court of Appeal, headed by the President, Manuel Sosa, heard his case this morning and invited both sides, including his attorney, Hubert Elrington, and the D.P.P. representative, to hand in further submissions on the matter by June fifteenth, 2015.  According to Elrington, he is appealing on three grounds. First, that trial judge, Justice Troadio “John” Gonzalez misdirected the jurors on the number of offenses of carnal knowledge proven by evidence, second, on whether or not it was proper to join the charge of indecent assault to those of carnal knowledge and third, that the judge should have imposed concurrent sentences instead of consecutive sentences. Nicholas was convicted on Tuesday, February twenty-seventh 2012, and sentenced to three twelve year jail terms for the three offenses of carnal knowledge’s and two years for Indecent Assault.   The then eleven year old girl testified that Nicholas had sexual intercourse with her on three occasions whilst at a home in Barranco Village and that he had touched her inappropriately on another occasion.
