Opposition Wants 13th Senator Appointed…Will File Claim

Last week, the People’s United Party took to the streets, and this week they’re taking the fight back to the Court. It’s not about Petrocaribe…well, not directly. This time, the P.U.P. is fighting for the long awaited appointment of the thirteenth senator, delayed for about five years. It’s been a campaign promise and was even enshrined in an amendment to the Constitution, but that’s where it ended. The P.U.P. is saying that Prime Minister Dean Barrow acted illegally when he refused to appoint the thirteenth senator, and Francis Fonseca told News Five that based on advice from their attorneys, they believe that they have a winning case.

“We’re filing a claim tomorrow or the latest on Wednesday…a claim in the Supreme Court dealing with the thirteenth senator issue. As you know it’s been almost five years since the sixth Amendment was passed, but Mr. Barrow has refused to bring into effect I think Section seven of that amendment which effectively deals with the appointment of a 13th Senator. He promised that publicly, he promised that in his Manifesto, but he has refused to do so because he says now that will lead to a paralysis in government. The lawsuit will be a claim in a Supreme Court seeking several declarations…but the main declaration is a declaration from the Court that his refusal as Prime Minister to bring that section of the law into effect is wholly arbitrary, it’s illegal, it’s unlawful, it’s unconstitutional and a declaration from the Court ordering him that he must bring that law into affect. The Governor-General has already assented to it. He has just refused to bring it into law.”


It is also been years that there has not been a functioning Integrity Commission because appointment of members has not taken place.
