SICB Will Not Set Crop Start Date

In a letter to B.S.C.F.A. Chairman Ezekiel Cansino on Wednesday, a resolution was put forward instructing the B.S.C.F.A. and its committee of management to support the application for a writ of mandamus filed by Teck to have the court order the Sugar Industry Control Board set a date for the start of the crop season.

“In terms of the mandamus now, we filed the permission for the mandamus on Tuesday and what I asked the attorney was to go again to court and speak with the relevant parties and ask them if it can be heard urgently because we make urgent applications and basically what we’re saying is that with this matter time is of the essence and we want you to hear it as urgently as possible.  And the court usually complies, they understand that although the court is on recess right now there is an emergency judge that sits and so we are hoping that by early next week it will be heard and we haven’t gotten a date yet but at least they know what is our plea on the matter.  Meanwhile it means that while we can we work to prepare all our ducks in a row to go to court and have a mandamus.  The mandamus we will not withdraw unless the Sugar Industry Control Board does what the law mandates it to do and fix date, fix it and put it in the gazette.  Then there will be no need for mandamus; however, what my client Mr. Teck is considering is that even if we withdraw the mandamus because they have disputed, the government and the board and the manufacturers, have disputed what that section means, he is prepared if necessary to go to court…or not every year we will go through this and we cannot allow anyone to forever use that provision to hold the cane farmers at ransom.”
