US Capital Energy Attorney says SATIIM’s legal challenge is all about money

Country Representative for U.S. Capital Energy Ltd., Alistair King, as well as Executive Director Greg Ch’oc, of the Sarstoon-Temash Institute for Indigenous Management, SATIIM, were back in court this morning.  Both parties awaited a decision by Justice Michelle Arana for an injunction to halt pre-drilling activities within the Sarstoon-Temash National Park, formerly co-managed by SATIIM.  The application was filed in the Supreme Court on March twelfth.  SATIIM contends that U.S. Capital is acting above the law by failing to take into consideration a pending decision on a legal challenge brought against the Government of Belize in a matter which also involves the protected area.  U.S. Capital, for its part, says that there is nothing that prohibits the company from doing preparatory work.  While a decision on the injunction was not handed down today, a date for a judgment on the substantive matter, SATIIM’s existing suit against G.O.B. is set for next Thursday.  Following the adjournment, News Five spoke with attorney Michael Peyrefitte, who boldly asserts that at the heart of SATIIM’s argument is dollar and cents.

“The only time this matter was brought to court was when there was an issue as to what cut the Mayan leadership would get from this.  And let me tell you something else, I have been in meetings with them you know, they have done a great job of looking like they are such big time victims and they are not.  They all speak great English, although they pretend not to.  They’re all well educated, well trained, well backed and when you talk to them, no matter what you talk to them about, it all comes down to their share of the pie.  [They’re] no different, I guess I can respect the teachers who make no qualms about it, “we want money, we want a raise.” The Mayas should be just as honest with the people of Belize and say their only issue with this case is their cut of the pie.  It’s not about some…”

“What about the evidence though, with all you’ve said just now in relation to what this is all about, money.  What has been presented before the court by way of this assertion that you’ve made and the communications…”

“Nothing, nothing substantive.  The judgment is due next week Thursday and I don’t want to comment on the merits of it but one of the most telling things is this, the space occupied by U.S. Capital for this project is approximately four acres out of forty-odd thousand acres and you ask yourself this Adele, if it is so important to you that the environment be preserved, if it is so important to you that such activities not take place, why do you keep abandoning your application for injunction? Why? Let’s be clear about one thing Isani, there was never any injunction in place against the government or U.S. Capital. We were informed last year, as you know, that the matter would have been expedited and heard and decided on by November 2013.  It wasn’t, but all the other side had asked us [is] when we plan to drill.  We had indicated to them that there is no way we would drill by November, before November 2013.  So we indicated to the court that if this matter can be heard and decided upon before then, then there will be no need for any injunction.  That should tell you right there and then that there is nothing urgent to have an injunction against.  I mean, you have to look at the timeline of this thing, the company built a seven kilometer road, almost forty feet wide and there was no application for an injunction.  They built a drill pad one hundred and ten meters by ninety meters, no application for an injunction.  The only reason, and I have no qualms in saying this, the leadership of the Mayan people applied for an injunction and brought an action in this matter was because they wanted a bigger share of the oil revenues should there be oil there.  That’s the bottom line for this, you know.”

H… of course the maya people talk English they are Belizeans and because of people like you they have to educate themselves and ensure that their rights as human being are respected and that nature should be preserved because unlike you they live from the land, so therefore they need to sustain it..
