COLA and D.P.P. prepare for case against Elvin Penner

The status of the criminal investigation might be very much in the air at this point, but a private criminal case has been lodged against former Minister of State Elvin Penner, and that case will be heard in Belmopan Magistrate’s Court on Thursday. The claimant is COLA, Citizens Organized for Liberty through Action, and their effort was immeasurably strengthened recently when D.P.P. Cheryl-Lynn Vidal jumped on board. Today executives of COLA, with private attorney Kareem Musa, met in Belize City with D.P.P. Vidal for a pre-case session. The media was waiting as COLA emerged. Not much could be said, because the case is sensitive and easily prejudiced, but COLA is ready to press on, and the D.P.P. will be along for the ride.

“We told you all we wrote three letters, one to the D.P.P., she has responded, we wrote one to the auditor general requesting all pertinent document, some would say that her response was not much of a response because she did respond to the letter to state that she is seeking advice from the solicitor general before releasing any document. We wait for the Commissioner of Police; I have not received anything up to this day, to this hour, nothing in writing form the Commissioner of Police.”

“The D.P.P. has indicated that she is fully aware of the role as the D.P.P. as Mr. Brackett just mentioned. There are individuals in the country who are paid to investigate, there are individuals in the country paid to prosecute and madam D.P.P. is fully aware of her responsibility and she will not abdicate on that responsibility, so she has indicated that she will be present tomorrow.”

“What do you all expect to happen tomorrow?”

“Tomorrow is the first hearing, it is the arraignment of Mr. Penner, I believe that he has been summoned, if he has not been summoned already and I believe that if he has been summoned, he should appear tomorrow.”



“Sir, can you be a little frank with us, do you guys have any materials in hand, I know you can’t discuss it but do you have any materials in hand?”

“Yes I won’t Daniel go into the evidence at this stage, but there is in fact a mountain of evidence. We are talking from the Commissioner of Police; we are talking from the D.P.P., a lot of people are in possession of files and we are actually in addition to the files that we already have I think you saw and the media has access to files as well. That was disclosed in the media and disclosed in the writ of mandamus hearing. But in addition to that evidence, there is also a mountain of evidence that the D.P.P. has and that the Commissioner has and as Mr. Brackett has indicated, we are still awaiting a response from the Commissioner of Police and we are still awaiting a response from the auditor general, none of who seem to care about this investigation at all.”

“I am saying here as the President of COLA that my colleagues are willing to sleep both in front of the Prime Minister’s office, the Commissioner’s office until they start to do what they are being paid to do. Which is to fight and defend on behalf of the people of Belize; I cannot understand how can people defend corruption in this way.”


According to Musa, there is no indication at this point if Elvin Penner has been served with a summons to appear. If he has been, and does not appear, the court can then issue a warrant for his arrest.
