D.P.P. finally presented with files on the investigation

Ten minutes ago News Five received an update from Director of Public Prosecutions Cheryl-Lynn Vidal via email. She confirmed that at five forty-three this evening investigators visited her office to finally present a file. Because of the late time we’ll bring you her written remarks verbatim. Vidal states, quote – “As you are all aware, the six month period of limitation for any possible offence under the Passports Act ended on fourth March 2014. The Order of the Court was made on third March 2014, but as indicated above, it was not until Wednesday that I was contacted. In relation to any possible offence under the Belizean Nationality Act, by virtue of the operation of Section twenty of the Summary Jurisdiction (Procedure) Act and Section fifty-five of the Interpretation Act, the period of limitation will end on eleventh March 2014. I must state at this stage however, that I am yet to see any evidence on the file which would enable me to give a directive for any charge under Section twenty-two of the Belizean Nationality Act. My analysis of the evidence presented to me thus far however, has centered around a consideration of a charge under Section one seventy-eight of the Criminal Code which makes it an offence for a person to “make a statement which is to his knowledge untrue for the purpose of procuring a passport whether for himself or any other person”. This is an indictable offence and IS NOT subject to any period of limitation. I have also given certain directives to the police in relation to the gathering of further evidence which would enable the consideration of yet another indictable offence which is not subject to a period of limitation. I trust that the investigators would act with dispatch in carrying out my directives so that there can be a resolution of this matter shortly.” This is a story that we will continue to follow.
