Immigration officers questioned, but not Elvin Penner

On Wednesday, Nationality Department Counter Supervisor Ady Pacheco was questioned by officers from the National Crimes Investigation Branch. Pacheco was prominently featured in the internal investigation into the Won Hong Kim passport scandal. So was Gordon Wade, the chief of the nationality section. He was allegedly questioned today. Both Wade and Pacheco played very integral roles in the procurement of the nationality certificate which led to the passport for Won Hong Kim. Both fingered former Minister of State Elvin Penner in the internal report, stating that he brought in the application without supporting documents and he pushed through the certificate. So there is some sort of investigation occurring, spurred no doubt by the writ of Mandamus. But is it for show, or for real? We note that so far there has been no evidence of Elvin Penner being called in for questioning, despite those involved pointing in his direction.

“The modus operandi of the Police Department in many, many cases when they are dealing with ordinary citizens is to charge that person with offences while the investigation is ongoing, while the investigation is taking place. There is absolutely nothing stopping the Police Department today from charging Elvin Penner with these specific offences committed under the Passport Act and the Nationality Act while they undertake their investigation and it would be very prudent of them to do so and very responsible of them to do so given the fact that they know that the statute of limitations expires on March ninth. Because if they do so then that is on the record, that is there…they can continue the investigation after that. If they, at the end of that investigation, conclude that there is not sufficient evidence for them to pursue those criminal charges then they can be dropped as is done very often by the Police and by the Director of Public Prosecutions but there is nothing stopping them today from going ahead and charging people for these offences while they carry out the investigation because there is, as the court determined, prima facie evidence, meaning that there is a basic level of evidence that is available already which requires and warrants a criminal investigation.”

 

Today, P.U.P. leader Francis Fonseca added some heat to the kitchen, writing to Commissioner of Police Allen Whylie to request an update on the investigation. In that letter, attorneys on Fonseca’s behalf remind Whylie that willful disobedience of the Court will make him liable to contempt proceedings. A deadline of two pm on Friday is given for a response from the ComPol.

    If this police commissioner does not do his job then he should be locked up also for corruption we belizeans need to forget about the police and start arresting all these corrupt officials ourselves making citizens arrest and hang all murderers.

    Please keep the heat on them. Also when you guys get back in control I hope you run the government the same way you are demanding the UDP do; by the way this is the correct way.

    The easiest way to stay in office is to do the right thing. After the election dust settles people do not really care who is in office as long as they are doing a good job because when the tide raise all boats will float.
