Director of Public Prosecutions says there is enough to warrant a criminal investigation

If there would be a criminal investigation, the Police would then enter the picture, and so would the Director of Public Prosecutions. Both those entities will only act if summoned by the Director of Immigration. That hasn’t happened, but an intensive internal investigation is supposedly still ongoing. The D.P.P. however says that from what she knows there is enough to warrant a criminal investigation. But as we said earlier, the Prime Minister in a not-so-subtle message has declared that Penner has not committed a crime.

“Penner was obliged to resign by me.  In fact, the letter, I believe, has now gone to the Governor General and, in effect, he was removed from the ministry by me.  And so I think that he has been properly punished for his role in the incident but I also said, both as a lawyer and as head of the government, I looked at the circumstances as closely and as fairly and as critically as I could and I am satisfied that there is no basis on which any criminal charges could successfully be laid.  There is no evidence at all that could sustain a criminal prosecution against Penner.  That is my position and I am telling you that that position doesn’t come about because I am in anyway trying to protect Penner.  He has been removed.  He has, in effect, been fired.”

 

While the D.P.P. has not made a public comment on the scandal, she has responded to queries by pointing out that the D.P.P. has the power to institute, undertake, take over, continue or discontinue criminal proceedings before any court of law, but not the power to investigate. The D.P.P. further states that, “The only means by which it can be ascertained whether a criminal offence has been committed and whether a prosecution can ensue, is by conducting an investigation and assessing the evidence that has been gathered. The institution with the widest mandate to investigate is clearly the Police Department.” And finally, she offers a very learned opinion, stating that, “I am of the view however,  that sufficient has been raised to warrant an investigation and I trust that the appropriate authority will proceed to do just that and thereafter forward a file for the consideration of this Office.”

    Liad…You have all the evidence, but the you PM want to take us for fools. What do you have to say now, when evidence is being destroyed as we speak. To destroy evidence is a massive crime.
