Another formal complaint is lodged for a criminal investigation

But even while the P.U.P. is gearing up for a recall, there is still the issue of a criminal investigation. A complaint was made earlier this week by WUB Morning Show Host, Mose Hyde, for a criminal investigation to be launched into the passport scandal. In the senate, a motion was also made to prompt an investigation into the matter by Opposition senator, Lisa Shoman.  But despite the cries for a criminal investigation, the Prime Minister says there is no need. Today, a member of Penner’s constituency, Cayo North East, is saying he is not sitting back. Marlon Robinson, a former political aspirant, says it is the mandate of the police department to conduct a criminal investigation into the scandal so he lodged a formal complaint with the Commissioner of Police, Allen Whylie.

“I felt it absolutely necessary, a civil duty, to formally launch a citizen’s complaint and take it to Belmopan. Unfortunately when I reached there today, I was told that he was not in the country, but that he will be arriving on Monday. I believe the entire nation of Belize; our sacred nation, the people of Belize, reasonably believe that a crime has been committed. And under the police act chapter one-thirty-eight, revised edition 2000 section twenty one-A Interalia states that the duty of the Belize Police Department shall be to preserve the peace, detect crimes, apprehend and summon before a magistrate persons found committing or whom they may reasonably suspect of having committed any offence. I believe the entire nation reasonably suspects Elvin Penner of having committed a criminal offence. Another thing, there is a legal principal in law that no man can be a judge in his own cause. My other reason for coming forward is that man time is of the essence. I wrote to the commissioner. I said listen, evidence may be destroyed—this is common sense, everybody knows this—and witnesses may be tampered with. Furthermore, people are demanding justice. Again under natural law, no one should be denied justice. Anybody can see that a crime has occurred; it is very likely. We have circumstantial evidence.”

“Exactly, where is the hardcore evidence?”

“When the Taiwanese embassy sends you a letter and says this has occurred. that is a credible source; that document can be tendered in court. Why is it that this isn’t happening? I am a member of Cayo North East, I had voted for Penner. He knows this and we are disgruntled with him.”

“Would you support a recall if Penner does not step down?”

    Every Belizean citizen can file a complaint by signing the recall petition.

    it will take years to figure out the number of crimes these guys committed, if ever.

    As the Supreme court put it in one case recent against GOB. To find in favor of the plaintiff all that needs to occur is that GOB has committed a crime. And the court has determined that at least seven felonies were committed by GOB.
