Rape and burglary suspect free, but may face charge in future

While the church is looking to its next day in court, a man accused of a heinous crime may see himself standing before a judge and jury once again.  In October 2009, the house of an elderly couple in the Freetown Sibun area was invaded and burglarized. The woman was also raped in the presence of her husband. But today, the only person accused for the crimes walked away from charges of rape and aggravated burglary. He is twenty-four year-old Cannon Augustine Obispo of the Freetown Sibun area, who at the time was living at San Pedro when he was accused of the crime. This morning in the Supreme Court of Justice Troadio “John” Gonzalez, Obispo’s trial ended in a nolle prosequi when Prosecutor Leroy Banner informed the court that his main witness, the sixty-year-old victim could not make it to the trial. The woman lives in Canada and could not come to Belize on such short notice but she can do so at a later date. Obispo is only free for now as the judge informed him that at any time when the prosecutor can get the witness to court to testify, the charges of aggravated burglary and rape can be brought back against him.  We spoke with Obispo outside the court room after he was granted his freedom. He told us that there is no evidence against him. On October twelfth, 2009, at about two in the morning, culprits gained entry into the home of the elderly couple by forcing their way through a window. They tied up the couple, raped the woman and held them up at gun point. They stole a number of items including a television set, a laptop computer, a digital camera and other items to the value of over thirty-two thousand dollars Belize currency.
