Not guilty in murder trial; accused was home with mother

After deliberating for four hours and a half, just after four this afternoon, the jury in the murder trial of Dwayne Evelyn returned a unanimous verdict of not guilty. And today, after being behind bars for two years Evelyn walked out of court a free man. Evelyn had been accused of the February 2010 shooting of Peter Myvett at the corner of Kut Avenue and West Street in Belize City. Myvett was shot multiple times by a gunman who then rode off on a bicycle. The crown’s main witness, Deon Torres, claimed he saw a man in a dark shirt and pants fire up to seven shots at Myvett, but he could not identify the shooter because he wore a mask. Sergeant Palomo, who apprehended Evelyn, stated that he heard the shots and saw when a man, he identified as Evelyn, threw down a mask. But while Torres says the shooter had on a dark shirt and pants, Palomo claims Evelyn had on a white shirt and dark pants. Justice Adolph Lucas pointed out the inconsistencies in the testimonies and advised the jurors that they would have to decide who they believed. And the jury of nine women and three men believed the accused, Evelyn, who claimed he was at home with his mother when the shooting occurred, and he was acquitted of the charge of murder.

    Disgusted, disgusted, disgusted. Oh well his faith is already sealed, he better stay close to his mama’s apron, I believe Myvett’s posse will bring him down.

    honestly the police can not just keep going on arresting people with no evidence. it is ridiculous that they have the power to throw people in jail on nothing. same thing happened to my husband but on a less serious charge. need to speed up the process to trial.

    I don’t think arresting a man who is taking off a mask, at the time and place where a masked man shot someone, is “no evidence.” Witnesses often remember things differently, such as color of clothes, and it is quite possible for a murderer to wear a dark shirt over a white one, and take one off, like he took off the mask, to change his appearance and try to escape.

    This defendant is a violent man, just 5 months before this murder he was charged for the armed robbery of Dave’s Furniture World. I wonder how that case came out?

    So, good job by the arresting officer, bad job by DPP and jury.

    Put a target on the defendant’s back, and let GSU hunt him.

    Well, i think our investigators need to learn that the new method of committing crime by these young men is to wear more than one shirt and as soon as the crime is committed they pull off the top shirt which hides a shirt of a totally different color and then they ride of walk by as if it is not them. but if our police would only take time to search the areas they would find the discarded shirts… but again … how do we help our investigators do a thorough job? The old days of witness id by clothes are gone.. these criminals are ahead of the police again!
