Musa will take Penner Petition to Appeal Court

Attorney Said Musa also commented on the proceedings, saying that they will take their claim directly to the Court of Appeal.

“We had applied to the court for leave to appeal the court’s decision that was made in the Orlando Habet matter when she struck out the allegations of bribery and all that. The court took the position today that it does not have jurisdiction to grant the leave, that we should basically go straight to the Court of Appeal and argue our case.”


Delahnie Bain

“You had raised a concern with that regarding time?”


Said Musa

“Yes, I raised the matter as to the time factor but as it happens we did file a notice of appeal to the Court of Appeal in any event.”


Daniel Ortiz

“Sir, so what happens with the appeal on the grounds of the recount? What’s the status with that?”


Said Musa

“Well, the court had given leave for us to proceed with that petition but, as you mentioned, that too is being challenged by the other side and that matter will be heard sometime next week I believe, Monday I think it is.”


Habet was also ordered to pay costs to the respondents. There are two other election petitions before the courts; Lee Mark Chang versus Francis Fonseca in Freetown, in which a decision is pending and David Craig versus Herman Longsworth of Albert, which involves a contract for the Marion Jones Stadium fence.
