2 sides to Carnal Charge; family of accused speak out

Forty-two year old Brian Charlesworth, a resident of Belize City, appeared in court on October twenty-fourth, a few days after allegations were made accusing him of sexually assaulting a pair of minors.  He has been on remand at the Belize Central Prison since before re-appearing before Chief Magistrate Ann Marie Smith this morning.  Initially, Charlesworth had been charged with aggravated assault of an indecent nature; however, that charge was upgraded to carnal knowledge today.  He is accused of raping a six-year-old girl after she alleged that Charlesworth had intercourse with her earlier this year.  No plea was taken since the matter will be dealt with on indictment and the accused will remain in prison until January twenty-seventh, 2012.  Following today’s court appearance, Charlesworth’s family visited our office where they shared their side of the story.  According to Thomas Charlesworth, his elder brother is being framed for a crime that he did not commit, especially since examinations of both minors allegedly proved that they were not carnally known.  He says his brother is falsely being profiled as a repeat offender.

“My brother’s parole was revoked on the twenty-second of October for an alleged case of carnal knowledge; however, both children in his relationship went to the medical examiner and they were certified that they were not carnally known.  However, on his charge sheet it did not say carnal knowledge on the twenty-second, it said aggravated assault which was then scratched out and he was charged with indecent assault.  We went to court today to have that thrown out because it’s actually not right to be charged with both incidents that are the same [only] to find that my brother is now charged with carnal knowledge of the other child which was also certified as not being carnally known.  So I come to the media to put it out there to the people.”

“Explain to us the union between Brian and his common law which has resulted in these allegations being brought against him.”

Thomas Charlesworth

“Well as far as I know when he started going out with this young lady she had two girls and a boy and the two girls are whom he is charged with molesting.  That’s what I know, to my knowledge; apart from that I don’t know anything else about the relationship they had.  I just know they live together with three children that are the girl’s children.”

“My understanding as well is that this may very well be a case of profiling seeing, as though your brother has served time for a similar offense.”

“That’s right Mr. Cayetano.  Eight or nine years ago my brother was charged with the rape of another young girl, his stepdaughter; however, according to the court documents that we got and the information that we got [is that] the perpetrator of the incident is an O+ person.  My brother being of blood group A and the young lady, the young girl that he allegedly raped being of blood type A he spent eight years of his life sitting in jail for a crime that by blood typing alone he didn’t commit.  Now he’s been charged with the same incident so they revoked his parole and seeing that both children had already been certified as not being carnally known this is just a case of profiling my brother and putting him in jail for something that he didn’t commit for the second time.”

    He spent years in prison for a crime that he admitted to and that significant evidence was presented tying him to the act. I am sorry i can’t be very sympathetic to Mr. Charlesworth cause. I knew of the case and worst of all I know the damage that his assualt of the child left behind.
