Paralyzed man charged with murder, but insufficient medical care in prison

The Orange Walk community is still coming to terms with the death of Dr. Enrique Guerra who was attacked in the early hours of May twenty-first. Guerra was hospitalized in a coma ever since and passed away early on Wednesday morning at the KHMH. The doctor was walking on Main Street in Orange Walk Town when he was ambushed by five men who allegedly attacked and robbed him. Twenty year old Richard Berry, twenty eight year old Crispin Moreno, twenty year old Alejandro Nunez and two minors were apprehended for attempted murder, but that charge has now been elevated to murder. A trial date has not even been set, but Moreno’s brother visited our newsroom and told us that his brother didn’t commit the crime. Moreno, who had already been charged with Attempted Murder, was one of the prisoners travelling in a prison van that overturned at mile thirty seven on the Northern Highway. He suffered a broken back and was hospitalized, but the tides have changed and he has been taken to the Central Prison. Today his brother claims that Moreno can’t receive proper medical attention in jail.

“But he can’t take care of himself.”

“No, my ma mi di take care of him while at the hospital but now nobody noh wah take care of him dah di prison cause the prison dah noh wa healthy spot fi make my lee bredda deh. And they no got no kinda equipments to deal with my bredda deh kidna way deh.”

“Is there anyone you can appeal to for help?”

“Whosoever control the country shoulda look into to this because this dah far pass the mark. I wah know if dah dog di eat dog or if dah jankru di eat jankru?

Cause I know jankru noh eat jankru.”

Jose Sanchez

“So your brother is remand section, he is not convicted of anything?”

Fernando Moreno

“Yes. He is remanded and I really wah know why they wah have a person weh paralyzed da prison. We need somebody fi deal with this situation faster than weh they think bout. As far as I know, da me help out my lee bredda in the financial while he mi deh dah hospital and I end up losing my job because I was doing this for my lee bredda because the ones deh weh in charge ah it; they noh di do nothing fi we. And they tell my ma that ‘cow dead and horse fat.” So I wah know dah who wah take care ah these things fi my lee bredda because then dah they got ahn ina this situation because my bredda mi di walk good, everything.  And now because they accuse he, because the police got a problem with we. I no know what da di problem.”

In the accident, Prison Warden, Delbert McLaughlin died and several other prisoners were injured when the van suffered a blow out of three tires and flipped several times.

    Big Brother, Is it possible that you are exaggerating your brother’s condition? The accident was horrible, it was tragic but let’s not forget that your brother was in that place at that time because the police believe he committed a crime. I wish I could muster up more sympathy but I can’t, I am sick pf people getting away with murder.

Attention Arthur Saldivar, Attorney at Law…there is a Prisoner in Kolbe whose Constitutional Right is being neglected….if anyone sees Mr. Saldivar kindly inform him of this urgent need of assistance….if he has that unconditional kindness that he claims to be, ref. Menjivars detention that he is unable to stay in Kolbe Hotel,, Mr. Saldivar this guy needs your assistance to take him out of prison….

    I know this young man from when he was a child…. unfortunately his parent did him no justice in the manner in which he was brought up. This man has been in and out of police custody for various crimes and the last one the most gruesome one. Life has ways of catching up…

    I’m sorry but I can’t sympathize with the moreno family …… When one does bad he deserves bad. How dare them go public asking for ppl to have pitty on them ???What about the innocent Doctor and his family . He was a hard working man who was did not deserve what happened to him .I’m catholic and I’m sorry but I can’t feel sorry for what the Moreno’s are going through.

    When the PM evicted those people from the Chetumal street area most people on this blog were saying that we’re a nation of laws.So why is a nation of laws violating it’s Citizens human rights.The laws of Belize are just enforced when it benefits the so called high class Belizean.Not only was this young man’s human rights violated Is patient Bill of rights was also violated when released from the hospital knowing what his medical condition is.Furthermore what he did in the past is not a justification for depriving him of proper medical attention.So maybe Zenaida Moya shouldn’t be in office after misappropriating Belizean tax-dollars.And maybe she shouldn’t be given proper medical attention after committing such crime.It is also in my opinion that she should have been locked up.

    We should remember that our Laws says a person is guilty until proven guilty. If it is true that he is the one that killed the doctor then he is getting his just punishment from God but he is still a human being. Remember No One has the right to judge but GOD. Our country is in so much hell because we have stopped care about our brothers and sister in Christ.     In the end the wicked always gets judge. Some, after they die, and some while they are still alive. The wages of sin is punishment and spiritual death in the end. These evil folk deprived our Belize of a well needed doctor, as well as deprived a family of their love one.
    The accident involving the prison van was judgment on the evil doers.

    Folks allow me to give some food for thought about this very serious situation: Its obvious that some of the respondents know this accused and because of that they feel that he deserve to suffer, that the laws of KARMA caught up with him. If that is the case, then perhaps we can come to the conclusion that the laws of KARMA caught up with the prison officer that died as a result of the accident; and what did the good doctor do to deserve such a brutal attach from guys that probably knew who he was since he was practicing in Orange Walk?

    With regards to the police action in putting people on the street and broke down their place of dwelling, the government Minister justify the action because according to him, those people broke the law, and the society is one of laws that should be respected. What is good for the goose is good for the ganda: this accused person is inocent until proven guilty in a court of law, and until such time it is the duty of those that are in charge of his custody to treat him with dignity as if he is a free man. In a civil society the process of civility should be the order of the day. According to the law, there is a specific punishment for the crime that he is accused of, and that punishment will be the responsibility of the court if he is found guilty.
