Investigation confirms cops shot Eric Swan

Meanwhile, an internal investigation by police has determined that Eric Swan was indeed shot by a cop last Friday. And while he recuperates in the Karl Heusner Memorial Hospital, police are not yet clear whether any one officer will face trial for his shooting or even more seriously, Swan’s attorney, Michael Peyrefitte, is still waiting to see if he will be charged in connection with the murders.

“First of all they have to charge them. Both people who I represent, Eric Swan and Evan Tun, none of them have been charged with anything as yet. The investigation is still pending. If they charge them then we will have to see what the evidence is against them but certainly our side is that Eric Swan at no time was in confrontation with the police, at no time fired any shots at the police nor pointed a gun at the police. That’s our position at this point but we have to wait and see what evidence the police will come with if, if they charge Eric Swan and/or Evan Tun.”

Marion Ali
“But police are saying he was in the get-away vessel that they tried to intercept when shots were fired at them and they retaliated, injuring your client, Eric Swan.”

Michael Peyrefitte
“Well, like I said, if they decide to charge him with any offense then we will see exactly what they’re saying when we get the disclosure. So far, nothing has been indicated to me regarding any charge both of them. We just have to wait and see.”

Marion Ali
“What is his condition?”

Michael Peyrefitte
“Well, Eric was shot in the right leg and he’s at the Karl Heusner Memorial Hospital under observation and his condition is stable.”

Sr. Supt. James Magdaleno
“It wasn’t during a crossfire. Police fired at the boat and hence the reason Eric was injured in that incident.”

Marion Ali
“So it was by a police gunshot.”

Sr. Supt. James Magdaleno
“It was police who fired in that direction and injured Eric.”

Marion Ali
“What will come out of that?”

Sr. Supt. James Magdaleno
“That investigation is ongoing likewise. Inspector Rivero was here from the Internal Affairs and he is doing that aspect of the investigation. The file will go to the D.P.P., the D.P.P. will direct either there’s nothing for anybody answer for or if there’s anything for somebody to answer or one of the officers. It will go through a disciplinary tribunal but it depends on what the D.P.P. says. Either we go disciplinary or we go criminal.”
