P.U.C. Says Speednet Must Pay

P.U.C.’s Attorney Senior Counsel Fred Lumor says that since Speednet was reportedly issued a license in 2013, it has been benefiting and should pay what it owes. Lumor says that Speednet is relying on ‘excuses’ not to pay its bill.

“Since the license has been issued July of 2013, Speednet has not paid a cent as a license fee. They have taken the provision that the license that PUC issued to them is a provisional license and PUC has no legal authority to issue provisional license. They are supposed to issue substantive or what I call permanent license. So they have taken the view that until the PUC complies or satisfies certain pre-conditions they are not going to pay. The license fee is over one point five million and Speednet took the matter to the Supreme Court. Justice Michelle Arana ruled in their favor and we have appealed the court’s decision to the Court of Appeal. The arguments you heard this afternoon is connect with this appeal and judgment is reserved to some future date.”

“However Speednet has been operating…”

 

Fred Lumor

“…on the license and they are still operating under that same license.”

 

Hipolito Novelo

“…collecting from customers as well.”

 

Fred Lumor

“Yes. They have made over five million dollars.”

 

Hipolito Novelo

“I think Senior Counsel Courtenay mentioned that they want that publication to be made in terms of the spectrum. One of the things that I believe one of the justices of appeal asked what has been the hold back in terms of that publication.”

 

Fred Lumor

“That publication, they are using as an excuse not to pay. It is not required by any law.”

 

Hipolito Novelo

“There is no law that says…”

 

Fred Lumor

“There is none that says you need to publish that particular thing in order for me to issue frequency authorization. They are using that as an excuse not to pay. We are saying that P.U.C. is under no legal obligation to make that publication as a precondition for payment.”

 

Hipolito Novelo

“One of the things I believe that one of the justices pointed out is that Speednet is operating unlawfully when it comes to that clause of the license.”

 

Fred Lumor

“They raise it because they are saying that if you are saying that the license issued by PUC is not valid in law which means that you are not operating under any valid license then you are going against the law.”

 

Hipolito Novelo

“Mr. Courtenay used the word defacto.”

 

Fred Lumor

“Defacto. Yes.”
