Attorney Estevan Perrera: This Was Both a Moral and Legal Win

Mayor Daniel Guerrero and his team were represented by Attorney Estevan Perrera. Following the C.J.’s ruling, Perrera told the press that the law recognizes that errors and minor miscalculations would be made during an election. He said that the provisions provide that if those errors and miscalculations are substantial and would affect the ultimate outcome of the elections, the results would be set aside by the court for determination. Here is how Perrera explained it.

 “The persons who drafted the act were very clever because they expected the fact that there will be errors because we are all humans. So those minor errors that they brought about as we maintained from the start are so minor that it did not affect the ultimate results of the elections. The votes were as they are. The numbers remain as they are. There was nothing untoward that would have affected the number of votes that each of the candidates received. Because of that the court made this judgment, solidifying that section of the act and stating that the minors which we point out were not sufficient in this case to put aside the election. I am glad that it is finally behind us so that our clients can now move one without this image that something went wrong with the elections. The calculations in this case weren’t in respect to numbers not adding up. What had happened in this case is that they knew the total number votes made and they knew the number of votes that were counted. When they looked at the numbers, by simply using deductions they were able to ascertain the other numbers that needed to be filled in and where the errors were. It was not a case wher they were missing voters. If that was the case then the court would have ruled otherwise. But in this case it was not a situation that votes were missing when the numbers were added.”

“In this case do you feel that his was a moral win or just a legal win?”

“This was both a moral and legal win. As we have maintained from the start we don’t believe that the petition had any merit to it because by simply looking at the forms one can easily recognized where the miscalculations were.”
