Court Spares Ibrahim Smith Additional Time for Accidental Gunfire Death

While he remains behind bars for other offenses, twenty-six-year-old Ibrahim Smith has been determined to have already served his time of thirty months or two and a half years’ imprisonment on a charge of manslaughter by negligence. Smith pleaded guilty in March, admitting responsibility for the death of his friend, seventeen year old Shenaine Reyes, whom he accidentally shot while playing with a firearm in November of 2010. According to Smith, he had actually given the gun and the cartridge inside to a friend to keep, having first taken the cartridge from the weapon. When it was returned to him, he did not know that the cartridge was back inside the gun, and fired by default when he pointed it at Reyes. Smith says he is ready to move on after taking a new path in life and devoting himself to caring for his now eight year old son. While attorney Leeroy Banner asked the court to agree to a non-custodial sentence, as in the case of Edwardo Torres who was fined fifteen thousand dollars in a similar case a few months ago, Supreme Court Justice Collin Williams said the firearm was not lawfully used and Smith admitted to directly and negligently causing Reyes’ death. He chose to halve the standard five year sentence to two and a half years, then deducted a third for the guilty plea, another seven months for showing genuine remorse and cooperating with police and the final nine months from the time served on remand, leaving him with time served. Smith continues in jail on firearm related offenses concerning the firearm used in the incident as well as handling stolen goods since the weapon was stolen.
