Police Respond to Questions on Response and Treatment of Paul Ferguson

The department disputes the presence of a mobile patrol in front of the Sit and Sit Nightclub, but says that police officers arrived on the scene moments later. But Grant was never taken into custody.  Instead, Ferguson was detained and taken to the Queen Street Precinct and held for a few hours.  According to ACP Phillips, the mobile strike team happened upon the verbal exchange while on routine patrol of the area.

“Why wasn’t he arrested in the first instance seeing as though this happened in plain view of the mobile strike team?”

“This, I have to say, based on the investigation, this incident did not occur in plain view of the officers.  The officers came upon an argument, not that incident that was reported.  So the officers used their own discretion and decided how the matter would have been dealt with by them.  But, like I said, a formal complaint was thereafter lodged and that’s what we’re investigating.”

 

Reporter

“So the officers, indeed on the footage we saw them appear after but were they, as far as you know, in the area when Mr. Grant pulled his weapon?”

 

ACP Dezerie Phillips

“No they were not.  They were assigned to patrol the entire Fort Street area and they came across a confrontation, an argument between two persons.”

 

Reporter

“Now I know nightclubs are a persistent concern for security; the drinking and the inflamed tempers.  We know that Mr. Ferguson was out there as a vendor but he also, according to anecdotal reports, had been after quite a few persons that night because, you know, he noh got no license pan ih mouth, to use that colloquial expression.  Is this an area that you all will be looking at in terms of trying to de-escalate future conflicts before they occur?”

 

ACP Dezerie Phillips

“Well, as much as we possibly can, when and where we know they there are social functions occurring normally, whether it is police security or private security is provided we ensure that is done because once alcohol is being consumed security has to be there so we ensure that it’s done.  This incident did not occur within the confines of the Sit & Sip nightclub, it occurred farther up the street.”

 

Reporter

“Will any charges be contemplated against Mr. Ferguson? We saw him speaking in a very, it seemed insulting way, speaking down to police officers.  He admitted that he cursed at the police officers because they refused to arrest Mr. Grant.”

 

ACP Dezerie Phillips

“Well I cannot comment at this point in time that any charges will be laid upon him.  I know that the police officer, one of them had brought him into custody for the purpose of him being disrespectful and disorderly out there.  But again, according to the officer who had brought him in, he spoke to him and managed to calm him down.  I mean that’s the discretion that the police can exercise so I cannot comment at this time and say with certainty that any charges will be leveled against him in that regard.”

 

While police say they have enough to proceed with charges, it is not known when that will happen.
