NEAB Out of Section 53 Appeal; UNIBAM’s Caleb Says They Were Taught a Lesson

On Tuesday, Chief Justice Kenneth Benjamin, who, in August, authored the historic decision on Section Fifty-three of the Criminal Code of Belize, denied the application for leave to appeal made by the National Evangelical Association of Belize, who wanted to join the case as an interested party. The Chief Justice refused Anthony Sylvestre, holding brief for Richard “Dickie” Bradley, time to consult and ordered costs of seven hundred and fifty-dollars to attorneys for case litigant Caleb Orozco and the Attorney General. With the Belize Council of Churches; Belize Association of Evangelical Churches; and Belize Church of England-Corporate Body, also called the Anglicans, dropping out after the August decision, only the Roman Catholic Diocese and the Attorney General in part will be appealing. We will get to the latter shortly, but first, we obtained reaction from Orozco today. The NEAB, he told us, learned a valuable lesson about wasting the Court’s time.

“The interesting thing about the NEAB is that they submitted their documents to the wrong court. The other interesting thing is that they submitted documents which were not relevant for their involvement in the case. So they learned a valuable lesson about civil procedure rules when addressing litigation issues. Outside of that, the court case continues with the Roman Catholic Church submission and the submission of the Government of Belize. For us, we have seven days—not counting weekends—from when the Government, the NEAB and the RCC filed a submission on September sixteenth to get their documents and it was interesting to see how the NEAB documents were only received on September the thirtieth.”
