Speaker of the House has right to sue over Auditor General’s Immigration Reports

The Auditor General’s special report into the issuance of passports, visas and Belizean nationality names quite a number of elected officials, including Prime Minister Barrow himself.  He is cited in the seven hundred page document for recommending citizenship for his brother-in-law who lives in Sweden.  The audit also names Speaker of the House Michael Peyrefitte who recommended a passport for William Lindo.  The Auditor General mentions him as someone who should not have made a recommendation.  According to Peyrefitte, he is a member of the House of Representatives and can recommend; so he’s considering legal action against the Auditor General for her erroneous report.  Today, we asked former Attorney General Wilfred Elrington how such a process would work since the Speaker would essentially be suing government.

“Any citizen has the right to take legal action against the government if it is their view that any of the government’s agents or servants has done them wrong.  That is natural and normal, it’s done all the time all over the world, especially in countries where you have systems of the type that we have.  So there is nothing unusual or abnormal about that and that is a citizen’s right and it’s very important to understand, you know, that you can sue but it doesn’t necessarily mean that you are going to win.  So, but you do have the right, you have the constitutional right and I don’t think that anybody can fault the Speaker if he forms the view that he wants to do that.  He himself is an eminent attorney-at-law, as you know, and I am sure he would also consult with other lawyers as to what is his legal position in this situation.  I don’t have any difficulty with him doing that at all.”

    If he recommended someone that was NOT qualified to get a Belize passport , then he was not…NOT qualified to make that recommendation. In that case he was not qualified. So,if he was qualified to make recommendations, ok,but for those persons that were qualified to get a Belize passport, not for foreign jailed terrorists.
    And if the person that he recommended did get the passport legally, the judge will tell Peyrefitte, look ya my lee buay, the auditor made a good job, have a nice day.

    The UDP prize hog just want more money. If I was the Auditor General, I would say bring it on. I would not apologize. It’s just his government giving him more money to do nothing.
